Redressal agencies are the three tier Consumer Grievances Machinery under consumer protection act. To know about the various functions of these agencies, firstly we have know about the redressal agencies one by one.
Then"District Forum" is settled by the State Government in each district. Here, the Consumer can file a complaint in the court against any defective goods purchased which are involved in unfair trade practices adopted by any trader. This forum gives simple, inexpensive, and quick remedies for consumer complaints. Where the value of the compensation and goods or services if any, is claimed below 20,00,000(Twenty lakhs).
The District Forum send the goods for testing in the laboratory if needed then the agency take the decisions on the basis of facts and results declred by the laboratory.
If the consumer if not get satisfaction from this agency then he/she can file case again in State Commission within 30 days.
Features:
a) It has the jurisdiction in all over the district.
b) A person who is qualified to be District Judge may be its President.
c) There may be more than one District Forum in the District.
d) It includes the complaints which do not exceeding Rs. 20 lakh.
e) The State Commission has administrative control over all District Forum within the State.
The State Commission consistes of a president and two other members appointed by the State Government. Qualification of Member: The president should be retired Judge of High Court. It includes two other members, one man and one woman. They must be well educated and having experience in different fields.
Compensation Limit: Compensation value Rs. 1 crore to 10 crore.This can also consider appeals against orders proceed by the District Forum.
This commission follows the same procedure for getting rid of disputes, as followed by the District Forum. On the other hand, the order of State Commission is final, when there is no appeal preferred against it.
It is a quasi-judicial commission in India, set up in 1988 under the Consumer Protection Act of 1986. The central station/headquater is situated in New Delhi. It consists President and four other members including one woman. The members are appointed by Central Government. If the value of the complaint is more than Rs. ten crores, related to defects in goods and or deficiency in service. If the aggrieved party is not satisfied then the consumer can file the case in Supreme Court within 30 days.
The National Commission issued instructions regarding:
(1) The application of a uniform procedure for hearing the complaints and issues.
(2) Previous service of copies of documents produced by one party to the opposite parties.
(3) To over-seeing the operations of the State Commissions and the District Commissions to make sure the objectives of the Act.
